Welcome to Fotochest.com (“Platform”). These Terms of Service (“Terms”) govern your use of the services provided by Fotochest. By using the Platform, you agree to be bound by these Terms. Please read them carefully.

1. Description of the Service

Fotochest provides a service that allows users to temporarily store and share high-resolution photos and videos through a gallery. Users can rent a gallery for a fixed period, such as 6 months or 1 year, after which the uploaded files are deleted.

2. User Responsibilities

• Content Responsibility: You are solely responsible for all content (photos, videos, etc.) you upload to the Platform. You represent and warrant that you own the copyright to the content or have the necessary permissions to upload it.
• Prohibited Content: The following types of content are strictly prohibited:
  • Content that infringes on any third-party copyright (e.g., unauthorized photos or videos).
  • Adult content, obscene, or inappropriate materials.
  • Illegal, harmful, or malicious content.
  • Viruses, malware, or other content that may harm the Platform.
• Usage Rules: You agree to use the Platform in compliance with applicable laws and in a manner that respects the rights of other users.

3. DMCA Compliance and Copyright Policy

Fotochest complies with the Digital Millennium Copyright Act (DMCA) and takes copyright infringement seriously. Copyright infringement notifications and counter-notices are handled as follows:

• Copyright Infringement Notification: If you believe your content is being used without permission, please send a DMCA notice to dmca@fotochest.com. Your notice must include:
  • Identification and contact information of the copyright owner or authorized representative.
  • Description of the copyrighted work and its location on the Platform.
  • A statement that the claim is made in good faith.
  • A sworn statement that the information is accurate.
  • The signature of the copyright owner or authorized representative.
• Content Removal: Upon receipt of a valid DMCA notice, the alleged infringing content will be promptly removed or disabled.
• Counter-Notice: If you believe your content was removed in error, you may submit a counter-notice to dmca@fotochest.com, including:
  • Description and location of the removed content.
  • A statement that the content was removed in error or by mistake.
  • Your name, address, and contact information.
  • A statement consenting to the jurisdiction of the relevant court.
• Repeat Infringers: Accounts of users who repeatedly infringe copyrights may be suspended or terminated.

4. Account and Data Management

• Storage Duration: Uploaded content is stored for the duration of the rental period (6 months or 1 year) and is automatically deleted thereafter.
• Account Suspension or Termination: Accounts that violate these Terms may be suspended or terminated.
• Data Responsibility: Fotochest is not responsible for the loss or damage of user-uploaded content. Users are responsible for maintaining backups.

5. Limitation of Liability

Fotochest does not guarantee that the Platform will be uninterrupted or error-free. Fotochest shall not be liable for any loss or damage resulting from your use of the Platform.

6. Changes to the Terms

Fotochest reserves the right to update these Terms at any time. Updates will take effect upon posting on the Platform.
